Q: Can a condominium association prohibit the installation of hurricane shutters by an owner? I would believe they would have the right to dictate some of the requirements of the shutters but can they outright restrict the installation of same?

Q: Our board of directors for our homeowners' association often does not have a quorum present at board meetings since some members work or are frequently out of town. What can be done by a board in the absence of a quorum? If a quorum is initially established but some directors have to leave the meeting early, does the quorum still stand?

LOSING CONTROL: THE EFFECT OF FLORIDA STATUTES §720.3035 ON ARCHITECTURAL CONTROL PROVISIONS

The homeowner at the end of the street has installed an eight foot wood fence with rainbow painted planks which blocks the view of the lake, all without architectural approval. Prior to the recent changes to Florida Statutes Chapter 720, many associations would be confident in their authority to address this matter as a covenant enforcement issue using the architectural control provisions contained within their governing documents. However, architectural control was dealt a serious blow in the Florida Legislature's last session. The stifling mechanism was the addition of Florida Statutes §720.3035, which became effective July 1, 2007. Now that the dust has settled, and the new provision has been reviewed and analyzed, the true task of assessing its impact upon community associations begins.

After eight long years of extensive lobbying by banks and credit card companies to win Congressional approval, the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 that was signed into law April 20, 2005. Although community associations were not the leaders in this drawn-out battle, they can certainly claim victory in the outcome.
